The penalties vary depending upon the situations of each individual case. If the blood alcohol concentration (BAC) is between .08% and under .10%, the penalties are less still significant, but less than if the BAC is .10% or higher. There are many other factors that areimportant, such as crashes, injuries, higher levels of BAC. Also, if the offense occurred in a school zone, the penalties are increased (and these increased penalties apply even though the offense took place at 3:00 a.m. in the month of July).
